NEW YORK, January 1, 2019 - The Telephone Communications Privacy Act, known as the "TCPA," is a federal law passed to protect you from many types of junk telephone calls, text messages and faxes.  The TCPA prevents anyone from using an automated dialing system to call, fax or text you unless you gave them your prior permission.  The TCPA applies to debt collectors, telemarketers and salespeople with few exceptions.

The TCPA also prohibits a telemarketer from calling or texting your cell phone or landline if your number is registered on the National Do-Not-Call Registry.

The TCPA provides for significant damages against those who make prohibited phone calls or send prohibited texts or faxes.  Consumers who receive unsolicited calls, texts or faxes may be entitled to bring an action to stop the harassment and may collect between $500 and $1,500 per wrongful call or text.  Consumers can also take action against those who violate the National Do-Not-Call Registry and collect $500 per call, for every call but the first.
