Bragar Eagel & Squire, P.C., commenced this action on behalf of a class of certain Federal Family Education Loan Program ("FFELP") student loan borrowers whose loans were serviced Conduent Education Services. When an FFELP student loan borrower files an application to consoldate his or her loans into a federal direct loan, the servicer must provide a Loan Verification Certificate ("LVC"), verifying the principal balance and other information about the borrower's loans, within ten business days. Plaintiff Jeffery Chery alleges that Conduent failed to provide a timely LVC to thousands of student loan borrowers who submitted consolidation applications. Defendants' failure to comply with applicable regulations requiring the provision of Loan Verficiation Certificates within 10 days of receiving a request resulted in significant delays of borrowers' efforts to consolidate or pay off their student loans.
On March 29, 2019, the United States District Court for the Northern District of New York entered an order denying Defendants' Motion to Dismiss the Complaint.

All student loan borrowers who submitted an application to consolidate one or more Federal Family Education Loan Program Loans into a Direct Consolidated Loan between January 18, 2012, and the date of the Order certifying the Class, for which Defendants failed to provide an Loan Verification Certificate within ten days of receiving the request therefor.
