NEW YORK, May 19, 2023 – Although immobilizer technology is standard in most makes and models of vehicles, from 2011-2022 Hyundai and Kia produced vehicles without this technology. In recent months, these defects have fueled a TikTok trend popularizing theft of these vehicles in seconds, often by minors armed with nothing more than a USB cord.
We were retained to represent a putative class of Hyundai and Kia owners whose vehicles were impacted by the defect. The impact was such a big problem, that numerous other lawsuits were also filed around the country. After our case was consolidated with other consumer class actions, months of litigation and negotiation ensued. On May 19, 2023, the Parties reached a proposed settlement that would provide software upgrades for qualifying vehicles. Additionally, the settlement would provide qualified reimbursement costs to impacted consumers. The settlement includes a settlement fund of up to $145 million in out-of-pocket losses. The settlement still needs to be approved by a federal judge.
